Content is provided for general information only and may be changed, updated, or removed at any time without notice. We make reasonable efforts to keep information accurate but do not warrant that listings, pricing, availability, photographs, or descriptions are complete, current, or error-free.

3. No tenancy or contractual relationship is created

Nothing on the Website constitutes an offer to lease, a guarantee of availability, or a binding agreement of any kind. Listed units, rents, features, and incentives are subject to change or withdrawal at any time. Submitting an inquiry or expression of interest does not reserve a unit, create a landlord–tenant relationship, or obligate us to lease to you. Tenancy arises only upon a signed written lease, and applications are subject to viewing, screening, and approval at our discretion, in accordance with applicable law.

4. Acceptable use

You agree not to use the Website to: (a) violate any applicable law or regulation; (b) submit false, misleading, or fraudulent information; (c) interfere with or disrupt the Website or its security; (d) attempt to gain unauthorized access to any systems or data; or (e) use automated means to scrape, harvest, or collect information from the Website without our written permission.

5. Intellectual property

All content on the Website — including text, graphics, logos, the “Summers Block Rentals” name and marks, photographs, and design — is owned by or licensed to us and is protected by Canadian and international intellectual-property laws. You may view and print content for your personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

The Website may link to third-party sites and services, including Airbnb and social-media platforms. We do not control and are not responsible for the content, policies, or practices of those third parties. Links are provided for convenience only and do not imply endorsement. 7. Fair housing and non-discrimination

We are committed to providing equal housing opportunity. Consistent with the Alberta Human Rights Act, we do not discriminate in the rental of housing on the basis of race, religious beliefs, colour, gender, gender identity, gender expression, physical disability, mental disability, age, ancestry, place of origin, marital status, source of income, family status, or sexual orientation.

The Website and all content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

9. Limitation of liability

To the fullest extent permitted by applicable law, Binder European Delicatessen Ltd. (operating as Summers Block Rentals) and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of, or inability to use, the Website. Nothing in these Terms limits liability that cannot be limited or excluded under applicable law.

10. Governing law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. You agree to the exclusive jurisdiction of the courts located in Alberta for any dispute arising out of or relating to the Website or these Terms.

Privacy Policy

This Privacy Policy explains how we collect, use, disclose, and protect personal information through the Website and our rental operations. We handle personal information in accordance with Alberta’s Personal Information Protection Act (PIPA) and, where applicable, Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA).

1. Information we collect

• Information you give us through our inquiry/contact form: your name, phone number, email address, the nature of your inquiry, and any message or details you choose to provide.

• Rental application and screening information (collected later in the rental process, with your express consent): employment and income information, references, rental history, government-issued identification, and credit and background-check information used to assess your application. See “Tenant screening, credit and background checks” below.

• Information collected automatically when you visit the Website, such as IP address, browser type, device information, pages viewed, and similar analytics data collected through cookies and similar technologies.

2. How we use your information

• To respond to your inquiries and communicate with you;

• To assess rental applications and manage the leasing and tenancy process;

• To operate, maintain, and improve the Website;

• To send you information you have requested or consented to receive; and

• To comply with legal and regulatory obligations.

3. Consent

By submitting information through the Website, you consent to our collection, use, and disclosure of that information for the purposes described in this Policy. You may withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice, by contacting us using the details below. Withdrawing consent may affect our ability to respond to you or process an application.

Tenant screening, credit, and background checks. As part of assessing a rental application, we collect and use information to verify your identity, income, employment, and rental history, and we obtain credit reports and conduct background checks through third-party screening and credit-reporting agencies. We do this only with your express, informed consent, which we obtain in writing at the application stage before any such check is performed. If you do not provide this consent, we may be unable to process your application. Information obtained through screening is used only to evaluate your application and is handled in accordance with this Policy and applicable law.

Marketing communications. With your consent, we may send you commercial electronic messages — such as updates about available units, news, or promotions — in compliance with Canada’s Anti-Spam Legislation (CASL). Every such message identifies us and includes an easy way to unsubscribe. You may withdraw your consent to marketing at any time; we will still send the non-promotional messages reasonably necessary for an ongoing inquiry, application, or tenancy.

4. Service providers and disclosure

We do not sell your personal information. We may share it with trusted third-party service providers who help us operate our business — for example, our customer-relationship and form provider (currently HighLevel / “GHL”), email and hosting providers, and analytics providers — solely so they can perform services on our behalf. We may also disclose information where required by law or to protect our legal rights.

Cross-border note: Some of our service providers (including GHL) store or process data on servers located outside Canada, including in the United States. Where this occurs, your information may be subject to the laws of those jurisdictions, including lawful access by foreign courts, law enforcement, and government authorities. We take reasonable steps to ensure providers protect your information.

5. Cookies and analytics

The Website may use cookies and similar technologies to function properly and to understand how visitors use the site. You can usually control or disable cookies through your browser settings, though some features of the Website may not work as intended if you do.

6. Retention

We keep personal information only as long as reasonably necessary to fulfil the purposes for which it was collected, to maintain our business records, and to meet legal requirements, after which it is securely deleted or anonymized.
